1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use Smart Sale POS.

2. Description of Services

SMART SALE POS provides digital point-of-sale solutions including sales processing, inventory management, reporting, and related business tools. Features may change or be updated from time to time.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate and complete information.
• You are responsible for all activities conducted through your account.

4. Acceptable Use

You agree not to:

• Use the Services for unlawful or fraudulent purposes.
• Interfere with or disrupt the system or servers.
• Attempt unauthorized access to data, systems, or networks.
• Reverse engineer, copy, or resell the software without permission.

5. Subscription Billing, Fees, and Payments

• SMART SALE POS operates on a subscription-based billing model (monthly or annually, as selected).
• Subscription fees are payable in advance and are exclusive of applicable taxes unless stated otherwise.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You may upgrade or downgrade your subscription plan subject to applicable charges.
• Late or failed payments may result in suspension or termination of Services.
• All fees paid are non-refundable except where required under applicable laws of the United Republic of Tanzania.

6. Intellectual Property

All content, software, logos, trademarks, and materials belong to SMART SALE POS or its licensors and are protected by intellectual property laws of the United Republic of Tanzania and international treaties.

7. Data Ownership

• You retain ownership of your business data.
• You grant Smart Sale POS a limited license to process data solely to provide the Services.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted access. Maintenance, updates, or technical issues may cause temporary downtime.

9. Limitation of Liability

To the maximum extent of the subscription amount paid, SMART SALE POS shall not be liable for:

• Loss of profits, business interruption, or data loss.
• Indirect, incidental, or consequential damages.

10. Termination

We reserve the right to suspend or terminate your access if you violate these Terms or applicable laws.

11. Governing Law and Regulatory Compliance

These Terms shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania, including applicable electronic transactions, consumer protection, and data protection regulations.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the revised Terms.
